1. Who these terms are with
These terms are between you and Red Maverick Pty Ltd ("we", "us"), of Perth, Western Australia. They cover the Ceiling Radar projector, the Flightstrip display, the Callsign Home app, this website, and the online service the devices depend on (together, "the products").
By using the products you accept these terms. If you do not accept them, please do not use the products.
2. Beta status
The products are currently in beta. They are supplied for evaluation to a small number of users while development continues. That means:
- features may be added, changed or removed without notice;
- there will be bugs, outages and interruptions;
- data may occasionally be lost, and a device may need to be reset;
- documentation, packaging and pricing are not final.
We tell you this plainly so you can decide with your eyes open. It does not remove the consumer guarantees described in section 6.
3. The service the products depend on
The products require a working internet connection and our online service in order to show live flight information. If your internet connection drops, or our service is unavailable, the products will not show live flights until the connection is restored.
We may change, suspend or discontinue parts of the service, including to maintain it, to respond to a change in a third-party data source, or where we must do so for legal reasons. Where a change is significant and within our control, we will give you as much notice as we reasonably can.
4. Accuracy of flight information — and what not to use it for
Flight information is derived from data broadcast by aircraft and from third-party datasets and services. It may be incomplete, delayed or wrong. Some aircraft broadcast little or no identifying information, and some do not appear at all.
The products are for general interest and entertainment only. They are not aviation-grade equipment. You must not rely on them for navigation, for air traffic or flight safety purposes, for meeting anyone at an airport where timing matters, in an emergency, or for any other purpose where being wrong would cause harm or loss.
5. Acceptable use
You agree not to:
- use the products for any unlawful purpose, or to monitor or harass any person;
- attempt to bypass licensing or entitlement checks, or to interfere with our service or another user's device;
- resell, redistribute or commercially exploit the flight data the products display;
- reverse engineer our software except to the extent the law expressly permits.
You are responsible for using the products lawfully where you live, including any local rules about projecting light beyond your own property.
6. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Any voluntary warranty we offer is in addition to, and does not limit, these rights. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.
7. Warranty
Hardware sold by us is covered by a voluntary warranty against defects in materials and workmanship for 12 months from delivery, in addition to your Australian Consumer Law rights. The warranty does not cover accidental damage, misuse, unauthorised modification, or normal wear.
To make a claim, email [email protected] with your Device ID and a description of the fault. We will tell you what to do next and cover reasonable return costs for a valid claim.
Warranty terms, including the claims process and return arrangements, are being finalised as part of the review of this draft.
8. Orders, prices and delivery
The products are not yet on general sale. When they are, prices will be shown in Australian dollars and include GST where applicable. We may correct pricing errors and decline or cancel an order, refunding you in full if we do. Risk in goods passes to you on delivery. Delivery estimates are estimates, not guarantees.
9. Subscriptions
Some features — currently, following a specific flight, and the extended scan radius on Ceiling Radar — are or will be part of a paid "Pro" subscription.
Where you buy a subscription through the App Store or Google Play, the purchase, billing, renewal, cancellation and refunds are handled by Apple or Google under their terms, not ours. Subscriptions renew automatically until you cancel, and you manage or cancel them in your Apple or Google account settings. We do not process your payment and cannot see your payment details. Deleting the app does not cancel a subscription.
Pro features are not yet available for purchase.
10. Software licence
We grant you a personal, non-exclusive, non-transferable licence to use the software on the devices and the app, for their intended purpose, for as long as you comply with these terms. We keep ownership of the software, and of the Ceiling Radar, Flightstrip and Callsign Home names and branding. Your device installs signed updates automatically; keeping it updated is part of how it is supported.
Third-party data, airline names and logos shown by the products remain the property of their owners and are displayed for identification only.
11. Liability
Subject always to section 6, and to the extent permitted by law: we are not liable for indirect or consequential loss, loss of profits, or loss arising from your reliance on flight information; and our total liability to you in connection with the products is limited, at our option, to replacing or repairing the goods, resupplying the service, or refunding what you paid us for them.
12. Privacy
Our Privacy Policy explains what the devices and app collect and how we handle it. It forms part of these terms.
13. Changes to these terms
We may update these terms. The current version is always on this page, with the date above. If we make a significant change, we will take reasonable steps to let affected users know.
14. Governing law
These terms are governed by the laws of Western Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State. If any provision is unenforceable, the rest continues to apply.
